How much should I ask for when settling my own personal injury case?
Tony P asked:
I was involved in a car accident 8 months ago, the other driver accepted all responsibility. The repairs to my car totalled $9,000 and my medical bills were approximately $7,000. All of my injuries were muscular. I went to the chiropractor and had physical therapy. I am planning on trying to settle and want to find out what I should ask for as a starting point.

What state did this accident occur in? I am not sure you are even tort eligible. The threshold requirements vary from state to state. Some are verbal, some are monetary and in others your injury must be serious.
What exactly was your injury? How long did you treat? How long were you totally disabled and partially disabled? Miss any time from work?
Just to let you know the adjuster is going to question the need for both chiro and PT. Some of the medicals may not be paid if they feel the treatment was not reasonable and necessary. Make sure you provide them with ALL of your medical documentation, not just what you think they need.
Anyway, assuming you are tort eligible and you sustained a soft tissue injury only, had some partial disability, and you treated for approximately 32 weeks, the settlement value of your claim not including the medical expenses should be in the $6400 to $9600 range.
However, you really do provide little info, and case value varies widely from state to state.

Well, depending on what state you were in, you might not be eligible at all for any pain and suffering. Many states heavily discount chiro bills, as they inflate the charge, and, frankly, in the same 8 weeks or so of treatments, you’d heal naturally.
No one here can answer you, accurately, as we have no idea what state you are in. But if you get medical bills, ALL medical bills, you’re doing GREAT. But it will probably be all of the DOCTOR bills, and physical therapy bills, and two chiro visits.
